Construction and Demolition Debris

For decades, facilities that disposed of construction and demolition debris (C&DD) were subject to relatively minimal regulation compared to municipal waste and hazardous waste landfills. Stringent regulation of C&DD was not considered warranted, given the relatively inert characteristics of C&DD material.

In some states such as Ohio, however, the market for C&DD disposal is changing dramatically, and so is the public and governmental perception of the industry. C&DD disposal facilities now face increased government inspections, stiffer monitoring requirements, new disposal fees, and citizen opposition.

We assist owners and operators of C&DD facilities on a host of environmental issues. We guide them through the regulatory requirements for the siting, design, construction, operation, and closure of C&DD disposal sites. We negotiate installation permits and operating licenses and, where necessary, appeal unreasonable or unduly burdensome permit and license conditions. If a facility inadvertently violates environmental requirements, we negotiate appropriate resolutions of governmental enforcement actions. Where voluntary settlement is not an option, we vigorously defend our clients’ interests in court.
