We assist lenders and borrowers on any environmental issues affecting the financing of property purchases or operating capital loans. We evaluate the legal risks revealed by environmental studies of the secured assets, identify gaps in information for additional assessment, advise the client on managing the risks, and draft and negotiate protective environmental language for the transactional documents. During the term of the loan, we help the lender or borrower minimize environmental risks and negotiate or litigate indemnification requests.
