Compliance Counseling
For decades, we have advised clients on the complex and challenging questions of law that they need to answer to function from day-to-day. By consulting with us before taking action, companies can prevent government enforcement, neighbor complaints, and negative publicity from inadvertent violations of environmental requirements.
Enforcement Defense
Sometimes a company finds itself to be the target of a government lawsuit, administrative order, notice of violation, or demand letter. Where the client wishes to resolve the matter, we negotiate to resolve the government’s case. Where the government’s position may be unreasonable or unjustified, we aggressively defend our clients. In either case, we utilize our knowledge as former government enforcement attorneys to handle our clients’ defense.
Permits
Without the required environmental permits, a company may not be able to construct or operate a plant or business. Unfortunately, government agencies sometimes fail to timely issue the permits, or include impractical and costly provisions in the permit. We work with government officials to obtain timely, sensible permits. We also advise the client on latent issues in permit language that could cause unexpected expense and liability later. After acquiring the permit, we advise the client on the measures needed to comply with the permit.
